1. Agreement to Terms

2. Services Provided

PixelTwist provides custom web design, managed high-performance web hosting, domain management, and professional email configurations. The specific scope, deliverables, and timelines for each project will be outlined in a separate Statement of Work (SOW) or digital contract signed before project commencement.

3. Hosting & Uptime Guarantees

We strive for a 99.9% uptime SLA for all clients utilizing our managed hosting services. However, PixelTwist is not liable for temporary downtimes caused by:

  • Scheduled maintenance (of which you will be notified in advance).
  • Issues originating from third-party registrars, DNS providers, or ISPs.
  • Malicious attacks (e.g., DDoS) or events of Force Majeure.

4. Intellectual Property

Upon final payment for design and development services, the client assumes full ownership of the visual design and content of their website. PixelTwist retains the right to use the completed project in our portfolio, marketing materials, and case studies unless a specific NDA prohibits it.

5. Client Responsibilities

The client agrees to provide all necessary materials, text, and imagery required to complete the project in a timely manner. Delays in client feedback or asset delivery will directly result in adjustments to the project timeline.

6. Limitation of Liability

In no event shall PixelTwist or its suppliers be liable for any consequential damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on PixelTwist's website or hosted services.
